SECTION 1 LIMITATIONS
These warranties shall cover PBG Networks products and services. Any alterations to these warranties, either expressed or implied, will be valid only if such conditions are noted in writing in a signed contract or statement of work (SOW).
SECTION 2 PBG NETWORKS SERVICES WARRANTY
PBG Networks, Inc. warrants all pertaining to, and exclusively noted within the client’s the supplied proposal regarding workmanship and the installation and termination of the same for a maximum of (1) YEAR from the date of completion and subsequent project sign-off.
PBG Networks will use reasonable efforts to provide Services in a workmanlike manner. Customer must notify PBG Networks of any failure to so perform within ten (10) days after the date on which such failure first occurs. PBG Networks’ entire obligation, and Customer’s exclusive remedy, under this warranty will be for PBG Networks, at PBG Networks option: (i) to use reasonable efforts to re-perform the deficient Services within a reasonable period of time; or (ii) if, after reasonable efforts PBG Networks is not able to correct the deficiencies, refund the portion of any Services fee that corresponds to the failure to perform. PBG Networks total liability arising from these terms and conditions shall be limited to the total amount paid to PBG Networks under the client’s signed agreement.
The warranty will cover all product deemed defective and/or due to insufficient or failed workmanship. The warranty does not cover abuse, misuse, manmade damage, fire, flood or acts due to that of a non-manmade nature. This warranty does not cover modifications or alterations made by a party other than PBG Networks or a party authorized by PBG Networks.
EXCEPT PURSUANT TO THE LIMITED WARRANTIES EXPRESSLY DESCRIBED ABOVE, PBG Networks DOES NOT MAKE, AND HEREBY EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE PRODUCTS OR SERVICES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS SO THE FOREGOING LIMITATIONS MAY NOT APPLY TO CUSTOMER.
Warranty Support Requests
PBG Networks provides an online help desk service that enables Client to make technical inquiries regarding their warranty issue. Client may contact their project manager by phone, however, Client support requests will also need to be e-mailed to firstname.lastname@example.org. An individual to be designated by Client will have online access to PBG Networks Trouble Ticket Database to review status of Client service requests. Available during normal business hours (M-F 9-5 ET excluding holidays)
SECTION 3 PBG OPTICS WARRANTY
All products have been thoroughly tested for defects in material and workmanship. If any product should malfunction while used in its recommended environment during the applicable warranty period, PBG Networks, at its option, will repair or replace the product at no charge, provided the product or any part thereof has not been abused, misused, neglected, replaced, repaired, or modified. PBG Networks shall make the final determination as to the existence and cause of any defect. No warranty is made with respect to custom products produced to original Buyer specifications, except as specifically stated in writing by PBG Networks Buyer acknowledges and agrees that neither PBG Networks nor any agent or representative of PBG Networks has made any warranty, promise or guarantee regarding the product or its suitability for any particular use except as expressly set forth herein. PBG Networks warranty shall not be enlarged, diminished, or affected by, and no obligation or liability shall arise or grow out of, PBG Networks rendering of technical advice or service in connection with any product furnished there under. PBG Networks makes no representation or warranty whatsoever to Buyer with respect to the performance, appropriate use, safety or characteristics of the products, except as expressly provided herein. PBG Networks reserves the right to make modifications to both hardware and software without prior notification. THE FOREGOING EXPRESS WRITTEN WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ANY OTHER WARRANTIES OR REMEDIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALL WARRANTIES ON ALL PRODUCTS ARE NOT TRANSFERABLE TO ANY OTHER PRODUCT NOR ANY OTHER PERSON.
In the unlikely event of a defect or failed item, immediately make note of the part number, serial number, and issue. Email or call to submit part(s) and receive an RMA # via email. We will promptly send the RMA number and a prepaid label for shipping the defective product back to PBG Networks. Please let us know if there is a production link at stake, for we will often cross-ship to ensure minimal downtime. For customers who do not practice sparing, replacement product is usually ready to ship Next Business Day (NBD). Note: EOL product can take a few days to complete RMA process.
THE FOREGOING IS THE COMPLETE WARRANTY FOR PBG NETWORKS AND SUPERSEDES ALL OTHER WARRANTIES AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN. EXCEPT AS EXPRESSLY SET FORTH ABOVE, NO OTHER WARRANTIES ARE MADE WITH RESPECT TO PBG NETWORKS EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED HEREIN, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL PBG NETWORKS, INC BE LIABLE TO THE PURCHASER OR TO THE USER OF AN PBG NETWORKS, INC PRODUCT FOR ANY DAMAGES, EXPENSES, LOST REVENUES, LOST SAVINGS, LOST PROFITS, OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE PURCHASE, USE OR INABILITY TO USE THE PBG NETWORKS, INC PRODUCT, EVEN IF PBG NETWORKS, INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Warranty Duration by Product Line
Transceivers – Limited Lifetime Warranty
• PBG transceivers designed to reach less than 80 kilometers carry a serviceable Lifetime Warranty of 10 years from the date of purchase from PBG or an authorized PBG Networks distributor.
• Transceivers that are designed to reach 80 kilometers or further, or custom made PBG parts, the serviceable lifetime warranty is 5 years.
• Transceivers purchased that are not branded by PBG Networks will have a warranty provided by the original manufacturer. These products may only be returned in accordance with the return policy in effect for the original manufacturer. The warranties and technical support may vary from product to product.
Direct Attach Cabling – Limited Lifetime Warranty
• PBG Direct Attach Cables carry a serviceable Lifetime Warranty of 10 years from the date of purchase from PBG or an authorized PBG Networks distributor.
Media Converters – 5 Year Warranty
• PBG Media Converters carry a serviceable Lifetime Warranty of 5 years from the date of purchase from PBG or an authorized PBG Networks distributor.
Cables – Limited lifetime Warranty
• PBG warrants to the original purchaser that its jumper, breakout and trunk cabling will be materially free from defects under normal use and service for as long as the original user owns the product, or for five years after discontinuation of such product, whichever is sooner.
Cable Management – Limited Lifetime Warranty
• PBG warrants to the original purchaser that its Cable Management Systems will be materially free from defects under normal use and service for as long as the original user owns the product, or for five years after discontinuation of such product, whichever is sooner.
SECTION 4 HARDWARE RESOLD BY PBG NETWORKS
Hardware or services resold by PBG Networks that are not produced by PBG Networks shall be subject to the respective vendor’s warranty policy.
